Terms and Conditions, Nervous Driver©

The “Supplier” means David Wilkinson/Optimum Hypnotherapy/Nervous Driver. The trading address of the supplier is 15 Etherley Moor, Bishop Auckland, County Durham, DL14 0JU.

The “Recipient” means any person, persons or organization who accepts receipt of advice, goods and/or services from the supplier.

I understand that the supplier delivers hypnotherapy as part of their goods and/or services in an attempt to reduce or eliminate any neurosis that may have caused the recipient to experience difficulties whilst driving. This effect when successful is intended to return the recipient’s ability to drive to their previous standard or exceed that standard. The fear of driving audio lecture and booklet is intended to help the recipient to identify and correct a number of issues that may contribute to their driving difficulties.

Due to the limited availability of time to undertake practical training during the course and the inability to undertake practical training at all through the counselling and audio programme, the supplier can not guarantee a minimum safe driving standard following the use of their advice, goods and/or services. Also, the supplier can not guarantee complete theory knowledge of recipients, though the study of relevant theory material is recommended for those who's knowledge is incomplete.

Therefore, I the recipient accept full responsibility for the safety of my own driving following the use of the supplier's advice, goods and/or services.

If I am unable to determine whether or not my driving is safe following the use of advice, goods and/or services provided by the supplier, I will;

1. Refrain from driving until I can determine that my driving is safe.
2. Seek remedial advice and/or supervision from an appropriate source.

I am legally entitled and licensed to drive the vehicle used and I am at least the Age of Majority in my country (eighteen in England and Wales). Any vehicle that I provide for training is appropriately insured and is in legal and roadworthy condition. I understand that if I request David Wilkinson to drive the car I provide, it will be insured third party only.

I agree that if I pass on or sell any material provided by the supplier (copyright or otherwise) I accept full responsibility to any aggrieved third party by doing so. I accept that all rights are reserved by the copyright owner and understand that the aforementioned copyright is protected by applicable laws.

I am medically fit to drive and if I suffer (or have suffered) from any neurological, cardiovascular, psychiatric, visual, renal, respiratory or sleep disorder, including seizures. Or if I am diabetic, have drug or alcohol dependency or impaired cognitive function through my age or any other reason, I will consult with my doctor and use these products and/or services only with their guidance.

Furthermore, I agree to give full and frank disclosure of any information to the supplier that may effect the supplier's decision to supply me with advice, goods and/or services.

I will only use the audio programmes in a safe environment and refrain from other activities such as driving or operating machinery during and after use until I am fully capable of engaging in such activities safely. I the recipient accept full responsibility for the improper or inappropriate use of this material.

If I can not attend a booked date, I will give five clear working days notice for an alternative date to be arranged. Ten clear working days notice prior to the booked date is applicable for the refund of a deposit.

Any arrangement made between the recipient of advice, goods and/or services and a driving instructor recommended by the supplier is strictly and legally between the two parties involved and not the supplier.

English Law shall be used in the event of any dispute and both parties agree to its jurisdiction. If any English Law Court finds any part of this agreement to be invalid, illegal or unenforceable, then that part of the agreement shall be removed and the remainder of the agreement shall remain valid and enforceable.

Acceptance by the recipient of advice, goods and/or services from the supplier or this website shall be deemed conclusive evidence of the recipient’s acceptance of these Terms and Conditions.
